MYCHOICE TERMS OF USE

1. Acceptance of These Terms
These Terms of Use (“Terms”) constitute a legal agreement between you and MyChoice Financial Inc. (“MyChoice,” “Company,” “we,” “us,” or “our”) governing your access to and use of www.mychoice.ca, any MyChoice quote journeys, applications, messaging experiences, tools, functionality, content and other services that link to these Terms (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms or our Privacy Policy, you must not access or use the Services.
By using the Services, you represent that you have reached the age of majority required to enter into a binding agreement under the laws applicable to you. If you are using the Services on behalf of another individual or organization, you represent that you are authorized to do so.
2. Changes to These Terms or the Services
We may update these Terms from time to time to reflect changes to our Services, technology, business practices or applicable requirements.
The “Last Updated” date above identifies the most recent revision.
Where required by applicable law, we will provide additional notice of material changes.
We may also modify, add, remove, suspend, restrict or discontinue all or part of the Services at any time, subject to applicable law.
3. About MyChoice and Our Services
MyChoice provides digital tools that allow consumers to research, compare, request information about and connect with providers of insurance and other financial products or services.
Depending on the Service, we may help users compare or obtain information relating to products such as:
- automobile, property, life and other insurance products;
- personal loans;
- mortgages;
- credit cards; and
- other products or services offered by participating providers.
Our comparison or referral Services may be provided to consumers without a direct fee. MyChoice may receive compensation from insurers, brokerages, lenders, vendors, service providers, referral partners or other organizations when a user is referred to them, interacts with them or purchases a product or service.
Unless expressly stated otherwise, MyChoice does not itself issue the insurance policy, loan, mortgage, credit card or other third-party product being compared.
The applicable contract is ultimately between you and the provider that accepts your application or agrees to provide the relevant product or service.
4. Our Role in Insurance Quotes
MyChoice may allow you to request, retrieve, compare, review or modify information associated with an insurance quote.
Insurance quotes, premiums, savings estimates, coverage descriptions, eligibility information and other results shown or communicated through the Services are estimates or informational results unless and until confirmed by the applicable insurer or licensed insurance professional.
A quote is not:
- an insurance binder;
- a guarantee that coverage will be offered;
- a final insurance premium;
- an insurance policy; or
- a commitment by an insurer to provide coverage,
unless expressly confirmed by an insurer or person authorized to bind coverage.
Rates and eligibility may change after additional information is obtained or verified, after underwriting is completed, or after you modify information associated with the quote.
MyChoice may facilitate communication with a licensed insurance broker or insurer, but automated quote tools and general Website content are not substitutes for advice from a licensed insurance professional where such advice is required.
5. Information You Provide
You agree that information you provide through the Services will be truthful, accurate, current and complete to the best of your knowledge.
Insurance quotes and eligibility can depend materially on information such as:
- your identity and contact information;
- address;
- vehicle information;
- vehicle usage;
- drivers;
- licensing information;
- driving history;
- claims and convictions;
- insurance history;
- household information;
- property information;
- requested coverage;
- deductibles; and
- other underwriting information.
If you discover an error or your circumstances change, you should update the relevant information.
Incorrect, incomplete or misleading information may result in a quote changing and may affect eligibility, underwriting, coverage, claims or the validity of an insurance policy.
You remain responsible for reviewing information submitted to an insurer or broker and confirming that the final application and policy documentation are accurate.
If you provide personal information about another individual, such as another driver or household member, you represent that you have authority to provide that information where required by applicable law.
6. Automated and AI-Assisted Services
Certain MyChoice Services may use automated technologies, including artificial intelligence, language-processing technologies and automated conversational systems.
These features may allow you to:
- ask questions about an insurance quote or quote process;
- provide additional information;
- clarify previously submitted information;
- request changes to quote information;
- receive updated quote results after supported changes are processed;
- continue or complete portions of a quote conversation;
- schedule an appointment;
- request a telephone call; or
- connect with a licensed broker or other human representative.
An automated assistant may interpret a request you provide and communicate with approved MyChoice systems in order to retrieve, validate or update information associated with your quote.
Automated systems are not licensed brokers
Automated systems do not themselves act as licensed insurance brokers and do not independently bind insurance coverage.
They are intended to support the quoting and customer-service process.
Where insurance advice, licensed activity, underwriting judgment, binding authority or other human review is appropriate, you may be referred to a licensed broker, insurer or other qualified representative.
Automated responses may contain errors
Artificial intelligence and automated systems can misunderstand instructions or produce inaccurate, incomplete or inappropriate responses.
You are responsible for reviewing material changes made to your quote and important information presented to you.
You should not rely solely on an automated response when making a decision requiring professional insurance, legal, financial or other advice.
MyChoice may require clarification or confirmation before processing certain changes and may restrict, suspend or escalate automated interactions to a human representative where appropriate.
Our collection and processing of information through automated and AI-assisted Services is further described in our Privacy Policy.
7. SMS, MMS, RCS, WhatsApp and Electronic Messaging
Where you provide the required consent or where otherwise permitted by applicable law, MyChoice may communicate with you through channels including:
- SMS;
- MMS;
- RCS;
- WhatsApp;
- email;
- telephone;
- chat; and
- other electronic communication channels.
Messages relating to a quote or Service you requested may include:
- quote information;
- quote summaries;
- quote updates;
- follow-up questions;
- requests for additional information;
- reminders;
- appointment scheduling;
- broker contact options;
- responses to questions you send;
- confirmations of changes you request; and
- customer support.
Some messages and responses may be generated or assisted by an automated conversational system.
Message frequency and carrier charges
Message frequency varies based on your interactions and the Service requested.
Standard messaging, data or carrier charges may apply.
Messaging technology may vary
Message functionality and delivery may depend on your device, operating system, telecommunications carrier, geographic location and supported messaging technology.
A conversation may use SMS, MMS, RCS, WhatsApp or another available channel depending on the Services you have elected to use and the capabilities available.
Consent and marketing
Consent to receive communications concerning a quote or Service you requested does not automatically constitute consent to receive unrelated promotional communications where separate consent is required by applicable law.
Opting out
Where applicable, you may opt out of SMS, MMS or RCS communications by replying STOP or using another unsubscribe mechanism we provide.
You may reply HELP for assistance where that functionality is supported.
Withdrawal of consent from one messaging channel does not necessarily:
- cancel your insurance quote;
- terminate another Service you requested; or
- prevent MyChoice or a participating broker from communicating with you through another method where authorized or permitted by law.
We process personal information associated with electronic communications in accordance with our Privacy Policy.
8. Broker and Human Handoff
You may be offered the ability to:
- call a broker;
- request a broker call;
- book an appointment; or
- transfer an automated conversation to a human representative.
To make that handoff useful, MyChoice may provide the broker or other representative with relevant information associated with your request, including your current quote information and relevant conversation context, as described in our Privacy Policy.
This is intended to reduce the need for you to repeat information already provided during your quote journey.
A broker, insurer or other third party may be subject to its own terms, privacy policy, regulatory obligations and licensing requirements.
9. No Professional Advice or Reliance
General content available through the Services—including articles, calculators, comparisons, estimates and automated responses—is provided for informational purposes.
Unless expressly provided by an appropriately licensed professional, such content does not constitute:
- insurance advice;
- legal advice;
- financial advice;
- tax advice; or
- other regulated professional advice.
You should consider your own circumstances and obtain appropriate professional advice where necessary.
Although we take reasonable steps to maintain our Services, we do not guarantee that all information will always be complete, current or error-free.
10. Accounts and Security
Certain Services may require registration, authentication or an account.
You agree to maintain the confidentiality of passwords, authentication credentials and other security information associated with your account.
You are responsible for activity occurring through your account to the extent permitted by applicable law.
You must notify us promptly if you believe there has been unauthorized access to:
- your account;
- your credentials;
- your quote;
- your communications; or
- your personal information.
You must not attempt to circumvent security controls, authentication mechanisms, access restrictions or other technical protections associated with the Services.
11. Acceptable Use
You may use the Services only for lawful purposes and in accordance with these Terms.
You must not:
- provide information you know to be false or fraudulent;
- impersonate another person or organization;
- access or attempt to access information you are not authorized to access;
- interfere with the operation or security of the Services;
- bypass authentication or technical controls;
- introduce malware, viruses, malicious code or harmful material;
- launch denial-of-service or similar attacks;
- scrape, harvest or systematically extract content or data except where authorized by us or permitted by law;
- reverse engineer or attempt to gain unauthorized access to our software, models, systems or infrastructure;
- use robots, scripts or automated processes to abuse, overload or manipulate the Services;
- use the Services to send spam or unauthorized commercial communications;
- submit unlawful, defamatory, abusive, threatening, discriminatory, obscene or otherwise prohibited content;
- infringe intellectual-property, privacy or other rights of another person; or
- use the Services in violation of applicable law.
We may investigate suspected misuse and may suspend or terminate access where reasonably necessary to protect our users, partners, systems or legal rights.
12. User Content, Private Information and Feedback
Private quote and customer information
Information you provide through:
- a quote or application;
- your account;
- private chat;
- SMS, MMS, RCS or WhatsApp;
- email;
- customer support;
- an automated quote conversation; or
- another non-public interaction
is not treated as public content merely because you submitted it through an interactive Service.
Our collection, use and disclosure of that information is governed by our Privacy Policy.
Public submissions
If MyChoice provides a feature that expressly allows you to publicly post content, such as comments, reviews, community posts or other public contributions, you remain responsible for that content.
By voluntarily publishing content to a public portion of the Services, you grant MyChoice a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display and distribute the content as reasonably necessary to operate and promote the feature through which you submitted it.
This licence does not grant MyChoice an unrestricted right to publicly disclose private quote information, applications or private communications.
Feedback
If you voluntarily submit ideas, suggestions or feedback about MyChoice or our Services, we may use that feedback to develop and improve our business and Services without compensation to you, provided that our use remains subject to applicable privacy obligations regarding any personal information contained in the feedback.
13. Intellectual Property Rights
The Services and their contents, including software, source and object code, text, data, databases, graphics, photographs, video, audio, designs, interfaces, logos, trademarks, trade names, presentation and functionality, are owned by or licensed to MyChoice and are protected by applicable intellectual-property laws.
Subject to these Terms, MyChoice grants you a limited, revocable, non-exclusive and non-transferable right to access and use the consumer-facing Services for your personal, lawful and non-commercial purposes.
Except as expressly permitted, you may not:
- reproduce;
- distribute;
- modify;
- republish;
- transmit;
- publicly display;
- create derivative works from;
- commercially exploit; or
- systematically download
our content without our prior authorization.
All rights not expressly granted are reserved.
14. Third-Party Products, Providers and Websites
The Services may contain:
- information supplied by third parties;
- links to third-party websites;
- products offered by third parties; and
- integrations with insurers, brokerages, lenders, messaging providers, scheduling providers, analytics providers and other services.
We do not control third-party websites or services.
Your dealings with a third-party provider may be subject to the provider’s separate:
- terms;
- privacy policies;
- underwriting rules;
- eligibility requirements;
- licensing obligations; and
- contractual documentation.
You should review those documents before entering into a transaction.
A link or referral does not necessarily constitute an endorsement of every statement, product or service offered by the third party.
15. Insurance Products
When you request or compare an insurance product, certain personal information will be necessary to generate relevant quote information.
You should answer all questions truthfully and to the best of your knowledge.
Insurance providers may verify information supplied by you and may require additional information before providing or binding coverage.
Certain insurers or brokers may obtain information from third-party sources as part of underwriting where authorized by law and appropriate consent.
You are responsible for reviewing:
- assumptions used in your quote;
- information sent to the insurer or broker;
- coverage;
- exclusions;
- deductibles;
- limits;
- endorsements;
- premiums; and
- final policy documentation.
If anything is inaccurate, you should advise the applicable broker or insurer promptly.
16. Rate Alerts and Renewal Communications
Where MyChoice offers quote alerts, rate alerts or renewal-related Services, the specific frequency, timing and communication method may be described when you enroll.
Where consent is required for electronic communications, we will request that consent in accordance with applicable requirements.
You may withdraw from optional communications using the unsubscribe method provided.
17. Privacy
Our collection, use, disclosure, storage, retention, processing and protection of personal information is described in our Privacy Policy.
The Privacy Policy also explains how we handle personal information associated with:
- quote requests;
- messaging;
- automated and AI-assisted conversations;
- brokers and insurers;
- service providers;
- analytics;
- advertising technologies; and
- cross-border processing.
Where a particular collection, use, disclosure or communication requires separate consent under applicable law, we will seek that consent separately.
18. Geographic Restrictions
MyChoice is based in Ontario, Canada.
Our consumer-facing Services are primarily intended for persons located in Canada unless expressly indicated otherwise.
Certain products, providers or features may only be available in specific provinces or territories.
If you access the Services outside an intended jurisdiction, you are responsible for determining whether your use is lawful.
19. Service Availability
We aim to make our Services reasonably available but cannot guarantee continuous or uninterrupted operation.
The Services may be affected by:
- maintenance;
- telecommunications outages;
- third-party provider availability;
- technical failures;
- device compatibility;
- security events; or
- circumstances outside our reasonable control.
We may suspend or restrict functionality where reasonably necessary.
20. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND THEIR CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
MYCHOICE DISCLAIMS WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT THAT SUCH WARRANTIES OR CONDITIONS CANNOT LAWFULLY BE EXCLUDED.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE;
- EVERY QUOTE OR RESULT WILL BE AVAILABLE;
- EVERY AUTOMATED RESPONSE WILL BE ACCURATE;
- DEFECTS WILL ALWAYS BE CORRECTED;
- THIRD-PARTY INFORMATION WILL BE COMPLETE OR ACCURATE; OR
- THE SERVICES WILL BE FREE FROM EVERY HARMFUL COMPONENT OR SECURITY RISK.
NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYCHOICE AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
THIS MAY INCLUDE, WHERE PERMITTED BY LAW, LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, GOODWILL OR DATA.
THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
No provision of these Terms is intended to waive rights you may have under mandatory consumer-protection or other applicable legislation.
22. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless MyChoice and its affiliates, directors, officers, employees, agents, contractors, licensors and service providers from claims, liabilities, losses, damages, judgments, costs and reasonable expenses arising from:
- your unlawful use of the Services;
- your material breach of these Terms;
- public content you submit in violation of another person’s rights; or
- your violation of applicable law.
This provision does not require you to indemnify MyChoice for conduct for which indemnification cannot legally be required.
23. Suspension and Termination
We may restrict, suspend or terminate access to all or part of the Services where reasonably necessary, including where:
- these Terms have been materially breached;
- fraud or misuse is suspected;
- security is threatened;
- the Services are discontinued; or
- we are required to do so by law.
Termination does not affect provisions that by their nature are intended to survive termination.
24. Governing Law and Jurisdiction
Subject to mandatory laws that may apply to you, these Terms and the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Subject to any rights you may have under applicable consumer-protection legislation, disputes relating to these Terms or the Services will be subject to the jurisdiction of the courts of Ontario and, where applicable, the Federal Court of Canada.
25. Waiver
A failure or delay by MyChoice to exercise a right under these Terms does not constitute a waiver of that right.
A waiver is effective only to the extent expressly provided.
26. Severability
If any provision of these Terms is held invalid, illegal or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
27. Entire Agreement
These Terms and our Privacy Policy, together with any additional terms expressly applicable to a particular Service, constitute the agreement between you and MyChoice concerning your use of the Services.
